Advising an International Industrial Group of Companies in the Resolution of Cross-Border Disputes Exceeding EUR 3 Million

REVERA’s lawyers advised the Russian subsidiary of an international industrial group, whose parent company is headquartered in Sweden, in connection with complex cross-border commercial disputes arising out of the supply of high-tech industrial equipment for mining enterprises.

The project involved full-scope legal support in cross-border litigation at all stages, from pre-trial analysis and the development of a strategy for protecting the client’s interests through to court proceedings before the courts of the Republic of Belarus, as well as subsequent advice on the recognition and enforcement of Belarusian court judgments in the competent courts of the Russian Federation.

The disputes were considered under the substantive law of the Russian Federation and were complicated by multi-layered conflict-of-laws and regulatory issues, including the application of foreign restrictive measures (sanctions), as well as an analysis of their impact on the performance of contractual obligations and the admissibility of judicial protection.

The project required the coordination of legal positions across several jurisdictions and the development of a unified dispute resolution strategy taking into account regulatory restrictions and the cross-border nature of the legal relationships.

As part of the project, the REVERA team:

  1. conducted a comprehensive legal risk assessment at the pre-trial stage;
  2. developed a litigation strategy taking into account the cross-border nature of the legal relationships;
  3. advised on the cross-border recognition and enforcement of court judgments;
  4. ensured the coordination of legal positions in view of the legal requirements of several jurisdictions.
Aggregate amount in dispute: more than EUR 3 million.
