Cross-border dispute: conduct of proceedings in Belarus and issues of enforcement of judgments in Russia

The team handled a complex cross-border dispute, ensuring the protection of the client’s interests at all stages of the project — from preliminary legal analysis and the development of a defence strategy to court proceedings before the courts of the Republic of Belarus and subsequent advice on the recognition and enforcement of Belarusian court judgments in the competent courts of the Russian Federation.

Aggregate amount in dispute: more than EUR 3 million.

The dispute required an in-depth analysis of Russian substantive law, as well as consideration of conflict-of-laws and regulatory issues. Particular attention was paid to the application of foreign sanctions, their impact on the performance of contractual obligations, and on the availability of judicial protection.
