Changes in the registration of non-profit organizations
On January 21, 2025, Order No35 came into force, amending the Rules for the provision of the public service "State Registration of Legal Entities, Registration of Their Branches and Representative Offices". Now the registration of non-profit organizations will be carried out by the Committee of the Registration Service and Organization of Legal Services of the Ministry of Justice of the Republic of Kazakhstan, while earlier this function was assigned to the ministry itself.
The procedure for registering commercial organizations remains unchanged - it is still entrusted to the Government for Citizens State Corporation.
The Constitutional Court canceled the ban on judicial protection in disputes with bookmakers
The Constitutional Court declared unconstitutional the provision of Article 914 of the Civil Code of the Republic of Kazakhstan, which limited the right of citizens to judicial protection in disputes with licensed organizers of gambling.
This article allowed for a double interpretation and contradicted Article 913 of the Civil Code, according to which the relationship between players and organizers of gambling is based on a contract and is subject to legal protection. However, due to the wording of 914 of the Civil Code, the courts refused to consider claims if the organizer complied with the established rules.
Now this contradiction has been eliminated: the phrase "if the organizer of the gambling business complies with the conditions for gambling and (or) betting" has been excluded from Article 914 of the Civil Code, which actually blocked the possibility of judicial protection.
The decision of the Constitutional Court entered into force on February 7, 2025, is binding and not subject to appeal.
The rules of self-restriction in gambling have been changed
Now citizens of the Republic of Kazakhstan can extend self-restriction for a period of 6 months to 10 years, taking into account previous applications. Previously, only the submission of a new application was provided.
The list of grounds for refusal to include in the list has been expanded. Among the new reasons is the submission of an application in an inappropriate form or its absence. Also, applicants who have not specified the period of restriction, or third parties who are not close relatives, can be refused.
If there are grounds for refusal, the authorized body is obliged to notify the applicant of the preliminary decision and schedule a hearing within two working days.
Application forms have also been updated, they have added obtaining the applicant's consent to the collection and processing of personal data. Exclusion of a person from the list is possible only on the basis of a court decision on the abolition of the restriction of legal capacity.
Pilot project. Foreigners will be able to obtain IIN at Kazakh embassies
Foreigners will be able to obtain IIN through Kazakhstani foreign missions. As part of the pilot project, foreign missions of the Republic of Kazakhstan will accept applications for an individual identification number (IIN) and issue it to foreign citizens.
The Ministry of Foreign Affairs of the Republic of Kazakhstan will be engaged in the issuance of IIN for employees of diplomatic missions and international organizations.
The following will be able to obtain IIN:
- potential investors and exporters;
- foreigners who have married citizens of the Republic of Kazakhstan;
- children of foreigners, one of whose parents is a citizen of the Republic of Kazakhstan;
- foreigners accepting the inheritance;
- Digital Nomad members;
- persons with disabilities and citizens over 65 years old.
The public service will be provided within one working day. The pilot project is designed until the end of 2025 and posted for discussion on the Open Regulatory Acts portal until February 6, 2025.
Kazakhstan plans to completely abandon paper sick leaves from April 1, 2025
According to the Ministry of Health, the preliminary deadline for the full transition to electronic sick leave certificates in Kazakhstan is April 1, 2025. From this moment, it is planned to abandon paper sick leaves, and information about temporary disability will be transmitted to employers only in electronic format through the hr.enbek.kz portal.
Currently, sick leaves are issued both in paper and electronic form, but the Ministry of Health has prepared changes to the rules for the examination of temporary disability, providing for a complete transition to a digital format. This will simplify the interaction of citizens with medical institutions and government agencies.
At the same time, the deadline for the introduction of electronic sick leave certificates is still preliminary and may change depending on the progress of the project and the approval of new regulations.
