New Foreign Direct Investment (FDI) Control Rules

As of 24 July, temporary COVID 19 pandemic regulations on foreign direct investment control have become a permanent part of Polish law.
The changes strengthen the protection of Polish companies in key sectors against hostile takeovers, covering, among others, infrastructure projects and strategic industries.

Significant Supreme Court Resolutions

  • Real estate transactions: Resolution III CZP 10/25 (11 July 2025) confirms that a copy of a notarially certified document does not constitute a valid basis for entry into the land and mortgage register.
  • Litigation costs: Resolution III CZP 11/25 (3 July 2025) rules that representation of a party in interim relief proceedings by an attorney-at-law or advocate constitutes an element of necessary litigation costs.

New Rules for Employing Foreigners (Labour Law)

  • Since the beginning of July, employers can handle the full process of employing foreign nationals online via the Praca.gov.pl portal – covering work permits, declarations of work assignment, and reporting of changes.
  • The government has also announced the rules for a pilot programme introducing shorter working hours, planned to start in 2026. Employers may apply from August, provided specific conditions are met.

Introduction of Temporary Border Controls with Germany and Lithuania

From 7 July 2025, Poland has temporarily reinstated border controls with Germany and Lithuania for migration security reasons.

These controls are justified under EU Schengen law. In practice, travellers should expect possible delays and longer clearance procedures at crossings, even though the borders remain formally open.
